1. General conditions
The Tour Operator
All the items present in this website are sold by Portugal B’side – TopSource lda., registered at Conservatória do Registo Comercial de Lisboa with nr. 513220747, and in Turismo de Portugal with license nr. 4909.
All prices mentioned in Portugal B'side website are in Euros and include VAT.
Who can buy
The purchase of goods or services is limited to parties that lawfully can enter into and do contracts on the website under the Portuguese law. This means that if it is an individual client, must be 18 years or older to purchase any good or service through the website. By offering to purchase any good or service means to us that you are 18 years or older (to rent a car you must be 21 years or older). In order to purchase, you must provide your real name, phone number, email address, credit card details and other information that may be requested. The website is only available for individual customers, companies or partnerships that we, in our absolute discretion, consider eligible. The eligibility criteria includes those who have been assigned a valid credit card by a bank that we accept and whose applications are acceptable to us. Also, this criteria includes those who have authorized us to charge the credit card the full amount of the purchase price of any good or service purchased. By offering to buy any good or service, you specifically authorize us to your credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial authorization for the credit card and to authorize individual purchase transactions.
We reserve the right to accept to decline or retain any person as a customer, if their conduct is disruptive and affects the enjoyment of other customers. We are not liable for any extra costs incurred by such person arising from their misconduct.
We have the utmost care to make sure that our suppliers maintain the highest possible standards. We are not responsible in any way for any problems, regardless of how they arise that result from the bookings of services that we do not directly control (hotels, car rental, private motorists and other activities). The responsibility of Portugal B’side is guaranteed by a Civil Responsibility Insurance in accordance with the current Portuguese law.
There won’t be made any refunds or exchanges with respect to accommodation, activities, transport or any other services, included in the price of the itinerary/trip after it has started. During your trip if, for any reason, you don’t use any of the services paid no refunds will be made.
Tour operator noncompliance
If for some reason we cannot predict, we are forced to cancel or change any of the services provided in the itinerary/trip you choose, you have the right to give up your reservation, being reimbursed according to our cancellation policy or accept the change and possible price adjustments. You can also choose another Portugal B’side itinerary with an approximate value; lower value tours imply the reimbursement of the respective difference in price as well as higher value tours imply the payment of the respective difference.
If you have a complaint
If you have a complaint during your holiday please refer the problem immediately to the supplier (hotel, car rental, driver, activity, etc.). Matters may be more easily resolved on the spot where the provider can see and understand the exact nature of any problems you may have. It is unreasonable to take no action whilst on holiday and make a claim later. In the unlikely event that matters cannot be solved on the spot we ask you to register your complaint in the Complaints Book of the supplier, and then send a report to our customer service department, and get in touch with us to try to solve the situation if possible. We will not accept complaints that haven’t been previously made to the supplier.
Portugal B’side can send all invoices via e-mail (e-invoicing). These Conditions may be complemented with other special conditions that are valid only when signed by both parties. This information is valid at the time of publication but is subject to modifications without notice. However, should any changes occur, they will be posted on the website in due course. If the Booking terms change after the deposit has been paid, the Booking terms under which the deposit was paid shall apply.
All participants must have their travel documentation in order and up to date (identity card, passport, driving license, minors’ authorization, and others that can be requested at time of travel). Any inconvenience caused by any failure on travel documentation is the responsibility of the participants.
After our availability confirmation email, we require the payment of 25% of the total cost to secure your booking. We will only book with the service supplier after we receive the payment confirmation by our bank. Please remember that if this process takes too long, some of the services may no longer be available. The remaining payment must be made within 15 working days before your arrival date. If we do not receive the final payment on this date, we will consider the booking as cancelled. Our cancellation policy will apply. In case you make a booking with less than 15 working days before your arrival date, the entire payment must be made at the time of reservation.
- If you cancel 10 working days or more prior to your arrival the cancellation will be free of charge.
- If you cancel within 5 working days prior to your arrival, you could be charged 25% of the total cost of the trip, depending on the cancellation policy of service providers.
- If you cancel in 4 working days or less from the arrival the first week of your trip will be charged. In case of Force Majeure, we will gladly work with you to either reschedule the tour, or try to obtain a full refund.
- If you don’t cancel (no-show) the total value of the trip will be charged.
Give your reservation to someone
You can give your reservation to anyone you want, since the person (or people) involved, fulfils all the Portugal B'side requirements for traveling. You must notify Portugal B’side at least 15 working days in advance and the change will only be guaranteed after the acceptance of the new person (or people) by suppliers. Portugal B’side will notify you the decision by email.
While providing our services, the information that we disclose is based on the information provided to us by our accommodation providers. Although we will use reasonable skill and care in performing our services, we cannot verify or guarantee that all of the information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (either for temporary and/or partial collapse, repair, upgrade or maintenance of our website or any other motive), inaccurate, misleading or untrue information or non-delivery of information. When making a reservation for our services, and after being indicated who will provide the service, you accept and agree with the relevant policy, cancellation and non-attendance conditions of that provider and any additional terms and conditions that the provider may apply to your booking or your stay, including services rendered and/or products offered by the provider (the providing terms and conditions of a provider may be obtained from the provider in question). The hotel provider classification of (group, type, stars) is determined by the Portuguese law.
The accommodation provided is only for the use of clients listed on the voucher and confirmed by us. Sublet, share or transfer is expressly prohibited. The prices shown are for the number of people included in the reservation in double occupancy rooms. Not all accommodations have triple rooms. In many cases they will probably place an extra bed, which may not be as comfortable.
Accommodation check-in and check-out times
The check-in schedule is usually at 4pm and the check-out at 12am. Despite some accommodations are available to store your luggage or get you a room if you need to change your clothes, you may pay locally this service if you arrive earlier or stay later (early check-in or late check-out). If you think you will need any of these services please mention it in your booking preferences.
The prices mentioned at Portugal B’side for a child reserve are only valid for children traveling with at least two adults and sharing the same room. If you are traveling with more than one child or have specific requirements in this regard you should always consult Portugal B’side for more information.
4. Activities and other services
Please be aware that many of the activities and services are constrained by weather or other conditions we cannot predict. As such, please contact us for detailed information of the activities and services you are about to book on our website. Please note that some activities or services have to be booked well in advance as they can easily fully booked. When making a reservation for our services, and after being indicated which provider will provide the service, you will accept and agree with the cancellation and non-attendance conditions of that provider and any additional terms and conditions that may apply to your bookings, including for services rendered and / or products offered by the provider (the supply terms and conditions of the provider may be obtained from the supplier in question). The activities or services you decide to book and pay on your own while you are on holiday aren’t part of the trip provided by us. Any other service that you book outside our company, your contract is with the operator of that service and not with Portugal B’side. We are not responsible for the provision of that service or anything that happens during the course of its provision.
5. Car Rental
The terms and conditions of our supplier are applied. To rent a vehicle, you must accept the provider conditions that will be presented to you when booking. Portugal B’side won’t be responsible for any hindrance collecting the vehicle by the provider for lack of valid documentation.
Age restrictions and required documentation
Minimum drivers’ age for car rental is 21 years and maximum 85. It is required that drivers must held a valid driving license for at least 1 year. For luxury vehicles or vehicles with capacity equal or superior to 7 places the minimum age is 25 years and the driver must have a valid driving license issued for at least two years. The vehicles can only travel in Portugal and can only leave the country with prior acceptance of the service provider (we can arrange all the details with the supplier). If you are resident in a European Union country and have a valid driving license in that country, you may drive in Portugal, and you will only need to bring your valid driver license and your valid identification document of your residence country. If you reside outside of the European Union make sure your driver license is within the validity period and it is recognized in Portugal with the Embassy or Consulate of your area. For some countries it may be necessary to apply for the International Driving License that you should always bring with you along with your valid driving license and valid passport with more than six months validity. For any rental you will need to supply a credit card on the same name of the person that is booking the vehicle and will drive it.
Insurance and Deposits
At the formalization of the rental agreement, you will be required a credit card to leave a deposit to the value of the insurance excess, to cover any missing fuel or damage. The deposit will be held on your credit card. Cash/debit card deposits will not be accepted. If the car is damaged during the rental you may be charged an excess, which will be debited from your deposit. The credit card presented must be at the same name as the holder's license and identification document or passport.
If you rent the GPS and lose it, we will ask for reimbursement of €100. In case of theft, please be sure to file a police report, and return the report to Portugal B’side so as to avoid this charge.
You acknowledge that all content included on this website, such as information, data, software, photography, graphics, sounds, images, illustrations, maps, designs, icons, written and other material and compilations are intellectual property and are protected by copyright which belongs to Portugal B’side and / or third party providers.
Corporate brand and trademarks
Portugal B’side and all other marks that appear on this website are trademarks. You may not use, copy, reproduce, upload, download, post, republish, transmit, distribute or modify the trademarks in any way, including advertising or publicity related to the distribution of materials on this website without the written consent of Portugal B’side.
Limitation for non-commercial use
This website is for your personal use and not for commercial purposes. You acknowledge that you sufficient legal to create legally binding obligations for any liability that you may incur as a result of your use of this website. You may copy and print electronically or on paper, portions of this website only for the purpose of using this website as a resource to purchase. Any other use of the materials on this website including reproduction for any other purpose than the mentioned above, such as the modification, distribution or republication without the prior written consent of Portugal B’side is prohibited.
All products, services, advice, merchandise and information available through this website are provided under the assumptions "as is", "as available" basic without warranties of any kind, either express or implied. No warranty is given or made, including but not limited to: (i) the use of this website and all software, products or services associated with this website will be error-free, (ii) regarding the completeness, accuracy, reliability or quality of any information content, data, service or merchandise provided or available through this website, (iii) concerning the availability of products and / or services through this website, (iv) that a user will receive the lowest available price for goods and / or services available through this website, (v) regarding the results that may be obtained from the use of this website, or (vi) regarding the performance or non-performance of this website.
General Limitation of Liability
In no case shall Portugal B’side and / or its respective suppliers be liable for any injury, death, loss, claim, accident, delay, or any special, exemplary, punitive, incidental or consequential damages of any kind, whether based in contract, or are in any connected with any use of this website or with any delay or inability to use this website, or for any information, software, products or services obtained through this website, even if one party has been advised of the possibility of such damages.
If you submit requests for or on behalf of a third party you are responsible for any error in the accuracy of the information provided under such use. Moreover, you must inform the third party of all Terms and Conditions applicable to all products or services purchased through this website, including all rules and restrictions applicable to them. Each user using this website, for or on behalf of a third party agrees to indemnify and hold each Covered Party harmless from and against any and all liabilities, losses, damages, actions and claims (including defense costs) in relation to the third parties or failure of the user to perform any of its obligations as described above. The user is directly responsible for any request submitted including related fees, charges and performance obligations.

- You don’t need to register or provide us information to view our website. However, when you visit our website, even if you do not make a request, it is possible that we keep some information such as your IP address, browser, or language configuration, shown web pages, or other, by using “cookies”.
A cookie is a small amount of data that is placed in the browser of your computer or on your mobile device that saves information related to your preferences, therefore, not including any personal data. - Portugal B’side can use third-party service providers to advertize and monitor marketing campaigns. Amongst others, we use Google Analytics Advertising Features implemented based on display advertising. We use Remarking to advertise online, therefore third-party service providers, including Google, can show their adds on websites you are visiting. These third-party service providers, including Google, use original cookies (such as Google Analytics cookie) and third-party cookies (such as DoubleClick cookie) together to inform, optimize and to monitor our users’ interests, and also, to communicate your ad impressions and your interaction with the advertising services that are related to your visits to our website.

- To request a service or information, we will ask you to register and provide only the information necessary to enable us to fulfil to your request. This information may be transmitted to the accommodation / rental car / activities / services from selected providers, so that they can book your itinerary/trip or provide any other information. Sometimes, the preparation or the fulfillment of these services requires Portugal B’side clients’ personal information to be shared with third parties. When it occurs, Portugal B’side ensures that these entities are trustful and indicate that will treat the information properly.
- Apart from the information we pass on to our selected accommodation / rental car / activities / services providers, we don’t share personal information with anyone.
- We take every precaution to protect the information related to clients. When users submit sensitive information via website, your information is protected both online and offline.
- Be aware that communications over the Internet, such as emails/webmails, aren’t secure unless they have been encrypted. Your communications may be routed, passing through a number of countries before being delivered - this is the nature of the World Wide Web. Portugal B’side cannot accept the responsibility for any unauthorized access or loss of personal information that is beyond our control.
- We do everything in our power to protect users information. All information of our users, and not just the sensitive information mentioned above, is restricted in our offices. Only employees who need the information to perform a specific job (for example, our billing or customer service representative) have access to personally identifiable information. Furthermore, all our employees are kept up to date with our security and privacy policies.
- The servers that store personally identifiable information are kept in a secure environment, in locked facilities.
